To ensure the compliance and fairness of platform services, this Disclaimer (hereinafter referred to as "this Statement") is formulated based on the applicable laws and regulations of the Hong Kong Special Administrative Region of the People’s Republic of China ("Hong Kong"). It aims to clarify the rights and obligations between Luminai Technology Limited (hereinafter referred to as "the Platform") and users (including KOLs, hereinafter referred to as "You"). As an information service provider, the Platform does not engage in content creation or review, but reserves the right to delete or restrict illegal or inappropriate content.
Important Notice: This platform does not provide services to users from Crimea, Cuba, Iran, Sudan, North Korea, Iraq, Libya, United States, Yemen, Afghanistan, Central African Republic, Democratic Republic of the Congo, Guinea-Bissau, Haiti, Lebanon, Somalia, South Sudan, Angola, Mainland China, Bangladesh, and other restricted countries and regions. All registered KOLs must comply with local laws and regulations. Please read this Statement carefully before using the Platform.
The Platform maintains an equal civil relationship with all registered KOLs (Key Opinion Leaders). The Platform does not assume any responsibility for reviewing or guaranteeing, and shall not be jointly liable for, content, behavior, or third-party links (including but not limited to the Twitter/𝕏 platform) published by KOLs, including disputes, losses, or legal risks arising from politically sensitive topics, pornography, violence, false advertising, intellectual property infringement, or other data fraud. All content published by KOLs (including text, images, videos, or links) is independently created by KOLs and is their sole responsibility, unrelated to the Platform. The Platform, acting solely as an intermediary facilitator, does not conduct any pre-screening, verification, or endorsement of the content of orders published by Buyers or the subject matter promoted thereunder (including but not limited to projects, products, or services). The content and legality of each order shall be the sole responsibility of the Buyer who publishes it. KOLs shall conduct their own independent due diligence on the Buyer and the subject matter of any order before accepting it. The Platform makes no express or implied representation or warranty as to the authenticity, legality, or commercial viability of any product, project, or service promoted through any order. KOLs agree to fully indemnify the Platform for any losses (including but not limited to fines, litigation costs, and reasonable attorney fees) caused by their content or behavior. If the Platform is compelled to bear liability for such content, the Platform reserves the right to seek full reimbursement from the KOL and require immediate removal of the relevant content, which does not exempt the KOL from bearing full legal liability.
Platform services (including content publishing, evaluation, point calculation, and promotional tasks) may experience interruptions, errors, data loss, or security risks (including viruses and malware) due to technical limitations, network fluctuations, or other reasons. You understand and agree that all risks (including economic losses or data breaches) from using the Platform services are borne by you, and to the maximum extent permitted by applicable law the Platform is not responsible for any indirect, incidental, or consequential damages.
The Platform shall not be liable for any service interruptions, delays, or inability to provide services caused by force majeure events (including but not limited to earthquakes, floods, wars, pandemics, government regulations, network failures, or third-party service interruptions). The Platform will make every effort to restore services but does not guarantee immediate repair.
The Platform operates as an intermediary marketplace facilitating transactions between Buyers and KOLs. The Platform does not guarantee the quality, accuracy, timeliness, or effectiveness of any content produced by KOLs, nor does it guarantee any specific results (including impressions, engagement, conversions, or return on investment) from orders or promotion services purchased by Buyers. All transactions are conducted at the users’ own risk. The Platform acts solely as a facilitator and shall not be held jointly or severally liable for any dispute, loss, or damage arising between Buyers and KOLs. In the event of a dispute regarding order quality or delivery, the Platform may review and make a determination in accordance with the Terms of Service; such determinations are final within the framework of the Platform’s rules but do not affect any statutory rights you may have under applicable law. The Platform shall not be liable for any loss arising from its dispute resolution decisions made in good faith.
Any prize pools, bounty programs, or other incentive campaigns (collectively, "Prize Pool Campaigns") available on the Platform are independently established, funded, and governed by the Buyers/Advertisers who create them. The Platform merely provides the technical infrastructure for display and facilitation. The Platform does not participate in determining prize pool amounts, setting distribution rules, or evaluating the reasonableness, legality, or solvency of any Prize Pool Campaign, nor does it endorse or guarantee any such campaign. KOLs who participate in Prize Pool Campaigns do so at their own risk and shall independently assess all associated risks. The Platform shall not be liable for any loss or dispute arising from participation in any Prize Pool Campaign. The Platform expressly prohibits and does not support any orders or transactions involving: gambling or betting, graphic violence, obscenity or pornography, drug or controlled substance trafficking, terrorism, money laundering, fraud, pyramid schemes, or any other activity that violates applicable laws and regulations of Hong Kong or the user’s jurisdiction of residence. Upon discovery of any such order or transaction, the Platform reserves the right to immediately remove the relevant order, withhold the related order funds, suspend or terminate the account(s) of the user(s) involved, and report the matter to the relevant law enforcement authorities and pursue legal remedies as available.
The Platform operates on a per-order payment model and does not provide any top-up, stored value, prepaid balance, or e-wallet functionality. Order funds held by the Platform pending completion, cancellation, or dispute resolution, and KOL earnings pending withdrawal, are not bank deposits, do not earn interest, and are not protected by any deposit insurance or protection scheme. The Platform is not a bank, deposit-taking institution, or custodian. Payments, refunds, and payouts are processed by third-party licensed payment service providers, and users may also be subject to such providers’ terms; the Platform shall not be liable, to the extent permitted by applicable law, for failures, delays, or errors attributable to payment service providers, card issuers, or banking systems beyond the Platform’s reasonable control, for exchange rate movements between the time of payment and any refund or settlement, or for losses arising from inaccurate or incomplete bank account details provided by users. The Platform shall not be liable for any loss, delay, or damage arising from actions taken in good faith to comply with its AML/KYC and other legal obligations, including account suspension, transaction delays, withdrawal holds, or the withholding of funds.
The Platform does not provide tax advice and does not assume any obligation to withhold, report, or remit taxes on behalf of users except where required by law. You are solely responsible for determining, reporting, and paying all taxes, duties, levies, and other governmental charges applicable to your use of the Platform, including but not limited to income derived from order completion and any other earnings. You agree to indemnify and hold harmless the Platform from any tax liability, penalty, or claim arising from your failure to comply with your tax obligations.
Special Reminder: If you violate this Statement or the applicable laws and regulations, the Platform has the right to immediately terminate your account usage rights, deduct points, or pursue legal liability. This Statement is an integral part of the Platform’s Terms of Service and has equal legal effect; in the event of any inconsistency between this Statement and the Terms of Service, the Terms of Service shall prevail. The Company has the right to update this Statement at any time, and continued use of the Platform after updates constitutes acceptance.
